POLICE DEPARTMENT CHANGES METHOD FOR POSTING DISCIPLINE
For those who use the department’s intranet, you know that it posts disciplinary actions on a monthly basis. It has become a concern of the DPA leadership that when a disciplinary action has been overturned or modified, during the appeal process, the final disciplinary action has not been similarly posted on the intranet. At the request of the DPA Executive board, I wrote a letter to Chief Kunkle (see insert) requesting that the discipline not be posted until it was either final, or if modified, asked that the modified discipline be posted. I am told that as of December 18, 2007, three (3) modified disciplinary actions can be found on the intranet. The department is doing the right thing now by publishing the correct information.

NAPO FILES AMICUS BRIEF WITH THE SUPREME COURT…..
The National Association of Police Organizations, Inc. (NAPO), to which the DPA is a member, has filed a motion for leave to file a brief with the Supreme Court of the United States in support of the State of Arizona’s attempt to overturn an Arizona Supreme Court ruling which held that a Tucson police officer could not search a vehicle recently occupied by a suspect after that suspect had been secured in a police car. The Arizona court effectively ruled that an officer must determine on a case-by-case basis the extent to which the passenger area of the vehicle was or was not within the arrestee’s control before a search is undertaken.
